As you have probably heard Judge Walker has struck down the California Law banning "same sex marriage"saying :
1. It violates due process.
2. It violates Equal protection under the Law
.
The thing that strikes me though is that it took Judge Walker 2 whole years to figure this out, what
about all the other Judges, Lawyers, Gay rights advocates etc? Was it so complicated that only the
"genius" of said judge could figure it out? He should be put in the Judges Hall of fame right now in a
glass case all by himself, he is too sharp to be sitting on a Court, a park bench maybe!
Ask any defense Lawyer and they will tell you that especially if the evidence is stacked against their client
or they lose the case, "Due Process" and "Equal Protection" are two of the most commonly use basis for appeals, especially in Civil right cases.
Well if I ever have to go too Court I would not use those Defense Lawyers(I could not afford them any way)
because they are incompetent, they have to be if they did not make sure their clients rights to "Due Process"
and "Equal Protection" was not violated, first thing.
This is just a case of Special Interest gone wild, somebody got paid real well, guess who? Could it be a certain Judge and his pals? Or could it be that this decision benefit he and his buds? See related article #1 below.
Here is a case of a comparatively small group - small in comparison to American and the World's populations
trying to get their way at whatever cost, regardless of the fact that their "lifestyle" is abhored
and considered MORALLY wrong by the WORLD at large.
They mis-interpret the fact that they are Tolerated out of Human decency - a moral act I may add, to mean they are accepted by most people, this is not so at all.
Homosexuals are tolerated because regardless of their chosen lifestyle they are fellow Human beings not animals, they are somebody's Brothers, Sisters, Friends, Neighbors, Co-workers etc, etc.
It should never have come to a vote but it did, the people spoke. By a narrow margin(not a surprise, after all it is California) they said no gay marriage .
Well apparently "we the people" have not constitutionally given right to determine Moral values for our
Comunities and Country, why vote if one's vote does not matter.
Why all the fussing and fighting, the blood, sweat and tears to give and to preserve the right to vote, if your
choice can be legaleased out by special interest and self serving authorities?
As reported by Msnbc on 8/04/10 here is what Judge Walker concluded :
"Moral disapproval alone is an improper basis on which to deny rights to gay men and lesbians. The evidence shows conclusively that Proposition 8 enacts, without reason, a private moral view that same-sex couples are inferior to opposite-sex couples," wrote Judge Walker.
"Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license," wrote U.S. District Court Judge Vaughn Walker in a 136-page decision. "Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couple.
In his comment above he spoke disparagingly about Moral disapproval, he need to go and read the Declaration of Independence where he will find that it was because they Morally disapproved of the
King's attitude and behavior that they fought and died to create this nation.
I was not there but I bet none of those people placed their Lives on the line for "gay rights"
He also spoke negatively about private moral view, in that too he missed it.
It was not private it was a very PUBLIC vote and the people spoked loud and clear "NO to PROP 8"
As Humans we have many limitations e.g can't tell the future, but we are able to determine laws and moral values, this is what separates us from other living creature and though we do not get it right at first or all the time we still must have boundaries and lines drawn albeit physical or otherwise, that is how we Humans roll.
That is how we know, what, when, why and where.
This seemingly regional matter is a definition of where we are as a culture and how we will move forward.
It is an assault on the foundation of this Nation, its constitution (the power of your vote), its history (the founding fathers and the declaration of independence) and the moral values of the mothers and fathers raising
the future Generations.

I agree that the people spoke out and like it or not, they did not approve of the Prop 8. I get miffed at the image we as Christians are given because we do not agree with something. We don't have to agree with something that we know do be against our morals and against our Heavenly Father. Just because we may not be for something does not mean we hate the individual. We love and we pray for them, we may speak out against their actions, but if you are doing it the way a God fearing person should, then it will be with love and fear for that person. Things have become so acceptable nowadays and that is just how the devil wants it. He wants the things that are wrong and the Bible loudly tells us so, to seem innocent and normal. We as Christians can Not give up, we have to continue to pray and warfare against all the evil in this world and keep this great nation that was (a long time ago) founded on Godly morals, Under God. It's so sad that I get so excited when I see or hear another Christian speaking the Truth and not caring that it may be harsh because he fears His God and is spreading the gospel. It's sad because it's not common and it's like we become fewer and fewer. I believe that really though there are more than we know, but they are silent and it's time to be silent no longer. We all need to speak up and be heard
